Property Settlement Agreements
Property Settlement and Stipulated Agreements – Only about five percent of all contested cases proceed to trial, but the courts are still crowded. Typically, participation in a settlement conference or some type of alternative dispute method is required prior a trial going forward. The law and the courts want parties to settle all or part of their issues outside of court. When parties do enter in a written agreement on some or all of the issues, such as property division, maintenance, parenting plan, etc., the court will endorse that agreement unless determined to be partially or fully unenforceable.
